Terms of Service & User Agreement

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“user”, “you”) and Mswahili Technologies (“we”, “our”, “us”) governing your access to and use of our platforms, applications, APIs, and services, including but not limited to Bantu Soko, Bantu Dereva, and Kadi (collectively, the “Services”).

By accessing or using any part of the Services, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into binding agreements in order to use the Services. By using the Services, you represent and warrant that you meet these requirements.

2. Account Registration & Security

To access certain features of the Services, you may be required to create an account. You agree to provide accurate, complete, and up-to-date information at all times.

You are solely responsible for maintaining the confidentiality of your account credentials, including passwords, OTPs, and authentication methods, and for all activities conducted under your account.

We reserve the right to suspend, restrict, or terminate accounts that are suspected of unauthorized access, fraud, abuse, or violations of these Terms.

3. Acceptable Use

You agree to use the Services only for lawful purposes and in compliance with these Terms and all applicable laws and regulations.

You must not engage in activities that may harm the platform, other users, or the integrity of our systems.

• Engaging in fraud, deception, or misrepresentation of identity or information
• Interfering with system functionality, security, or infrastructure integrity
• Using automated systems, bots, or scraping tools without authorization
• Harassing, abusing, or harming other users, drivers, merchants, or service providers
• Uploading or transmitting malicious code, viruses, or harmful content

4. Platform Role & Service Disclaimer

Mswahili Technologies operates as a technology platform that connects users with independent third-party providers such as drivers, couriers, sellers, and merchants.

We do not own, control, or directly provide the services offered by third-party providers. Each provider is solely responsible for the services they deliver, including quality, safety, legality, and compliance.

5. Payments & Transactions

Payments made through the Services are processed via third-party payment providers. By using the Services, you agree to comply with the applicable terms of those providers.

We do not store full payment card details on our systems. Responsibility for payment processing, authorization, and settlement lies with the respective payment providers.

We are not liable for delays, failures, or errors caused by third-party payment systems, network issues, or banking institutions.

6. Intellectual Property

All intellectual property rights in the Services, including software, design, branding, content, logos, and technology, are owned by or licensed to Mswahili Technologies.

You may not copy, modify, distribute, sell, or exploit any part of the Services without prior written consent.

7. Limitation of Liability

To the maximum extent permitted by law, Mswahili Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services.

This includes, without limitation, loss of data, revenue, business opportunities, goodwill, or service interruptions.

8. Suspension & Termination

We reserve the right to suspend or permanently terminate your access to the Services at our discretion, with or without notice, where we reasonably believe there has been a violation of these Terms, applicable laws, or platform policies.

Termination may include removal of access to accounts, data, or associated services without liability to the extent permitted by law.

9. Changes to Terms

We may update or modify these Terms at any time. Changes will be effective upon posting. Continued use of the Services after updates constitutes acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed and interpreted in accordance with the applicable laws of the jurisdictions in which Mswahili Technologies operates, subject to mandatory consumer protection regulations where applicable.
